Technical Workshop #3 - Current Status of ITCs & the Critical Considerations for their Implementation

The Canadian federal government has introduced new investment tax credits aiming to promote investment in clean technology in Canada, including the Clean Technology Investment Tax Credit and the Clean Electricity Investment Tax Credit. The Clean Technology Investment Tax Credit was included in Bill C-59 which received royal assent on June 20, 2024. Draft legislation for the Clean Electricity Investment Tax Credit, together with amendments for the Clean Technology Investment Tax Credit, was released by the Department of Finance on August 12, 2024. This workshop will provide a high-level overview of the key features of these ITC credits and some of the noteworthy tax considerations that arise from them. In particular, the seminar will address the use of partnerships and other legal forms such as corporations, and challenges respecting the at-risk rules, the tax shelter investment rules, and the complexities around meeting the labour requirements to obtain the maximum amount of the credits. This workshop will also discuss bridge loan funding of these ITC credits and some of the challenges and considerations relevant to borrowers and lenders in the implementation of these types of loans.
